Our firm successfully obtained summary judgment, dismissing all claims asserted against our client arising from a two-vehicle motor vehicle accident. The undisputed evidence established that our client’s vehicle was traveling straight when the co-defendant’s vehicle pulled out of a driveway and entered the lane of travel, causing the collision.
The plaintiff, a passenger in our client’s vehicle, failed to present evidence that our client engaged in any negligent conduct or contributed to the happening of the accident. Based on the record, Justice Kathy G. Bergmann, Supreme Court, Suffolk County found no triable issue of fact as to liability and held that summary judgment in favor of our client was warranted as a matter of law.
