Case: Appellate Division upholds dismissal of Plaintiff’s Appeal

In the underlying negligence action, Plaintiff’s Complaint against our clients was dismissed by the Supreme Court, Queens County. Plaintiff filed a Notice of Appeal and proceeded to engage in motion practice requesting extensions of time to perfect the appeal and additional emergency relief. MSD vigorously opposed the motions and the Appellate Division, Second Department, dismissed the appeal. Plaintiff continued to file multiple orders to show cause for additional relief and the Appellate Division maintained the dismissal and denied the requests for emergency relief.
