Case: Premises Liability/Alleged Assault

Counsel: Salvatore J. DeSantis, Julie E. Molod

Result: Case against building dismissed.

In Wang vs. Cambridge Security Services, et al, plaintiff alleged that she was assaulted by a security guard within the building owned by MSD’s client. The building had hired the security company to provide uniformed security services at the building. The assault occurred after the security guard’s shift had ended. Plaintiff brought a lawsuit against the building alleging negligent hiring and supervision of the security guard and failure to keep the premises safe. The New York Supreme Court granted our motion for summary judgment holding that we were successful in proving that the building did not hire or supervise the security guard and was unaware of any prior complaints about the security guard.
