Case: Labor Law Case Dismissed by the Second Department.

Result: Plaintiff claimed that he was injured while working at a construction site. As he was pouring a concrete floor, he tripped and fell over a protruding permanent drain pipe that was covered with a bucket to prevent concrete from entering it. Our office represented the plumbing subcontractor. The Appellate Division reversed the lower court and granted our motion for summary judgment finding that the allegedly dangerous condition was open and obvious and that our client lacked the authority to supervise and control the plaintiff’s work. Plaintiff’s Labor Law §200 and §241(6) claims were dismissed!
