Case: Motor Vehicle Accident

Counsel: Dennis Monaco and Amos Brunson

Result: Summary Judgment Granted Against Passenger Plaintiff

The plaintiff sought to recover for personal injuries allegedly sustained when a vehicle in which he was a passenger collided with our client’s vehicle. The plaintiff claimed to have sustained significant injuries, including a right shoulder arthroscopy, a right knee arthroscopy and a cervical discectomy. On the day of the accident the plaintiff’s vehicle was travelling on Empire Avenue, while our client’s vehicle was traveling on Sage Street. It was undisputed that a stop sign governed traffic proceeding on Sage Street at the intersection, but no traffic device governed traffic proceeding on Empire Avenue. The accident occurred when the plaintiff’s vehicle attempted to make a left-hand turn from Sage Street onto Empire Avenue and struck the passenger side of our client’s vehicle. MDS submitted a motion for summary judgment on the issue of liability as our clients had the right-of-way at the intersection. The Court granted the motion for summary judgment in favor of our client.
