Result: Summary Judgment Granted

Plaintiff alleged that their office space sustained $1,000,000 in property damage due to multiple water leaks from the roof during an HVAC replacement project at the building.  MSD’s client was the rigging subcontractor hired by the general contractor to deliver, rig, hoist and set the components of the cooling towers onto the structural steel above the roof on the 27th floor of the building.

MSD’s first motion for Summary Judgment was denied as premature, requiring our participation in extensive discovery.  Despite multiple depositions and expert affidavits, Plaintiff did not obtain any evidence of our client’s potential liability. After protracted litigation, our office successfully moved for summary judgment demonstrating that the work done by the rigging company in no way caused or contributed to the water leaks.
