Plantiff sued Arena claiming its negligence caused her to fall on a staircase. The case was dismissed by the Honorable Michael Montesano of the Nassau County Commercial Claims Civil Term after a bench trial. Still shots taken by the arena’s surveillance cameras, event reports, quality assurance documentation, and the testimony of multiple witnesses considered by Justice Montesano. Following the trial, the Court found that James Basile of MSD was able to establish that UBS Arena maintained the subject stairs in a reasonably safe condition prior to and during the Jodeci concert. Mr. Basile was further able to establish that UBS Arena lacked any form of notice of any dangerous condition which plaintiff alleged was prevailing on the stairs at the time of the incident. The action was dismissed in its entirety.
