Our firm successfully obtained summary judgment resulting in the complete dismissal of all claims asserted against our client. Judge Phaedra F. Perry-Bond of Supreme Court, New York County held that our client owed no legal duty to a plaintiff who claimed serious injuries resulting from a trip and fall on the sidewalk outside of the building where our client was a tenant.
The Court’s decision highlighted we satisfied our prima facie burden of demonstrating that our client did not create the alleged sidewalk condition, nor did they have a duty to maintain the sidewalk. As a result, our client was dismissed from the action in its entirety, bringing the litigation to a decisive close prior to depositions.
