Result: Summary Judgment Granted Dismissing Plaintiff’s Complaint with Prejudice
Plaintiff brought a suit claiming that when he was on our client’s premises, a pet-friendly multifamily apartment building, he was bitten by a dog belonging to the Co-Defendant, a resident of the building. Plaintiff was unable to provide evidence that our client or co-defendant had prior knowledge of the dog’s vicious propensities. MSD submitted a summary judgment motion dismissing all claims and cross claims against our client on the grounds that they did not own the dog, had no notice of vicious propensities, and lacked sufficient control over said dog to confine or control it. The Court granted the Summary Judgment motion, after oral argument, dismissing the complaint and all crossclaims as to our client with prejudice.
