Case: Summary Judgment Granted to Community Owner in Trip and Fall Accident.

Result: MSD represented The Sea Gate Association, a community in Brooklyn, New York. Plaintiff, a resident of the community, claimed that she tripped and fell on a temporary sidewalk that was put in place by Brooklyn Union Gas d/b/a National Grid, Hallen Construction and New York Paving within the Sea Gate Community. Justice Ingrid Joseph of Supreme Court, Kings County granted Sea Gate’s motion for summary judgment finding that Sea Gate had no responsibility for the sidewalks within the community, which were the responsibility of the individual homeowners. Moreover, the temporary sidewalk was part of a large scale gas line replacement project that was performed by Brooklyn Union Gas, Hallen Construction and New York Paving. Plaintiff’s case against Sea Gate was dismissed!
