Case: Summary Judgment Granted to Electrical Contractor in Wrongful Death Action.

Result: Case Dismissed Prior to Discovery.

MSD recently obtained early summary judgment in favor of an electrical contractor in a wrongful death action.  Decedent plaintiff was electrocuted while working on a residential renovation project.  MSD’s client was an electrical contractor, who had only pulled a permit for the premises where the accident occurred.  Our client did not work on the project.

We brought a pre-discovery motion for summary judgment based on the above facts.  Justice Karen B. Rothenberg of Supreme Court, Kings County, granted our motion, holding that our moving papers established, prima facie, that our client was not involved in the project and merely pulled the permit.  Opposing parties were unable to show any triable issue of fact reasonably expected to be probative if discovery were to continue.  Plaintiff’s case and all cross claims dismissed!
